Assessment 3 – Workplace or Simulated Activities

As a workplace activity, whilst on placement or during paid employment in the relevant industry, identify three (3) situations that you observed, that have legal and/or ethical considerations, and complete the questions and activity to demonstrate the underpinning knowledge and skills required to appropriately respond in each situation.

As a simulated activity, watch three (3) role played recordings through the links provided and read the corresponding scenarios and identify the legal and/or ethical considerations. You should observe the scenario as if you had just walked in on the situation, so you are a third-party person observing the incident.

These may relate to best practices, non-compliance or questionable work practices. Complete the questions and activity to demonstrate the underpinning knowledge and skills required to appropriately respond in each situation.Situation 1

  1. Identify and describe in detail the legal and / or ethical situation you have either observed during your placement, or watched and read in the provided link / scenario.
In this case study I observed a situation involving Miss Annette Curtain who is a 72-year-old widow. She is socially isolated and loves interacting with support workers. During a visit, I help to her with her phone and while doing so a text message appeared from a support worker inviting her for an early dinner and a show. However, I am aware that the support worker is not rostered for working the day.
This particular situation indicates ethical as well as legal considerations associated with communication boundaries, potential breach of organisation policies and client relationships (Schönberger, 2019).
  2. List relevant pieces of legislation and/or organisational guidelines that you would need knowledge of and may need to access, in order to respond to this situation. Provide a minimum of two (2) pieces of each
Relevant legislation are the Aged Care Quality Standards and the Privacy Act. The Aged Care Quality Standards focus that client have a right to be treated with respect and dignity, which comprises keeping professional boundaries. The privacy act highlights the significance of protecting personal information and confirming that there is consensual and appropriate communication (Char et al., 2020).
Organisational guidelines would probably address communication protocols and the significance of keeping professional relationships without participating in personal interactions other than scheduled tasks.
  3. In your role of a support worker and following organisation policy and procedure, how would respond in this situation?
Being a support worker, my response will be directed by the policies and ethical principles of the organisation. In this particular situation, I would approach miss curtain and gently discuss that it's wonderful that she developed a report with her support workers however it is essential to keep professional boundaries for maintaining her well-being and the integrity of work client relationship. I would kindly let her know that the invitation by the support worker may not align with the policies of the organisation and that the scheduling of activities is managed carefully for confirming personal support and care.
  4. Provide two (2) strategies that you could discuss with your manager that could be used to increase staff knowledge and awareness of how to respond if this scenario occurs again to ensure best practices are followed?
Concerning this scenario and improving staff awareness, I would suggest two strategies. The first is to conduct training sessions on a regular basis focusing on keeping professional boundaries and apt communication with clients. These sessions can include case studies and role-playing to improve understanding (Sperling, 2021). Secondly, the organisation can develop a clear communication channel for updates and scheduling confirming that clients are known about the availability and activities of support workers.
The implementation of these strategies would promote better understanding among staff members of the way to handle similar situations, confirming that the needs of the client are met and professionalism is maintained along with adherence to organisational guidelines.
  5. Following organisation guidelines for documentation, write a file note/report about this situation. Synchronising with organisational guidelines I would document this situation in a file note. Such a note would cover details concerning text messages my conversation with Miss Curtain and the significance of adding to professional boundaries. With the documentation of the incident, I would confirm that there is a record of my revert and the steps undertaken to address the situation while upholding ethical and legal standards.
Conclusively this scenario outlines the importance of upholding professional boundaries in client relationships. By addressing this situation correctly support workers can maintain legal and ethical standards while giving the best possible care to their clients.

Situation 2

  1. Identify and describe in detail the legal and / or ethical situation you have either observed during your placement, or watched and read in the provided link / scenario.
In this case, I observed a situation concerning Miss Sarah Adams. She is a 36-year-old individual with physical and intellectual disabilities. As per the support worker Bronny is being substituted by Virginia because of changes in support schedules, expresses her appreciation by gifting Bronny scratchy tickets worth $50 during their last visit. This situation involves an ethical dilemma about acceptance of gifts from clients and maintaining professional boundaries.
  2. List relevant pieces of legislation and/or organisational guidelines that you would need knowledge of and may need to access, in order to respond to this situation. Provide a minimum of two (2) pieces of each
Relevant legislation involves the Disability Discrimination Act, which focuses on the significance of treating individuals with disabilities fairly and without discrimination. Guidelines of the organisation typically address conflicts of interest, ethical behaviour and client relationships (Munoko et al., 2020).
Acceptance of gifts from clients can result in potential conflicts of interest compromise of professional boundaries and unequal treatment concerning ethical and legal grounds.
  3. In your role of a support worker and following organisation policy and procedure, how would you respond in this situation?
Being a support worker, my response will be guided by organisational policies and ethical principles. With the acknowledgement of gratitude Sarah, I would kindly describe to her that accepting gifts may lead to challenges in keeping a professional and unbiased relationship (Lustgarten et al., 2020). I would thank her for the gesture and discuss that my commitment to her well-being remains firm.
By refusing the gift I was focused on my primary responsibility to give her the best care and support assuring that my decisions are taken on the basis of only.
  4. Provide two (2) strategies that you could discuss with your manager that could be used to increase staff knowledge and awareness of how to respond if this scenario occurs again to ensure best practices are followed?
For addressing this ethical dilemma and improving staff awareness, I would suggest two strategies. The first is that the organisation could do training sessions regularly that are intended at navigating ethical dilemmas inclusive of scenarios involving gifts. These sessions can give support workers tools for navigating such situations and undertaking the right decisions. Further, I suggest the establishment of clear policies concerning gifts in client-worker relationships for providing guidance to staff members (Morley et al., 2020). This policy will highlight scenarios where gift acceptance is appropriate and where it may result in conflicts of interest. The implementation of these strategies assists workers in being better equipped to manage apical situations like gift giving confirming that the needs of clients are prioritized and conflicts of interest are evaded.
  5. Following organisation guidelines for documentation, write a file note/report about this situation. Complying with the guidelines of the organisation, I would document this situation in a file note. Such note will explain the circumstances relating to the gift, my response and the reasons for declining it. Documentation of the incident assures accountability and transparency in compliance with ethical standards.
Conclusively, the scenario surrounding Miss Sarah Adams underlines the significance of maintaining professional boundaries and avoiding conflicts of interest in client-worker relationships. The approach to the situation by declining gifts by support workers upholds their commitment to unbiased and fair care to their clients.

Situation 3

  1. Identify and describe in detail the legal and / or ethical situation you have either observed during your placement, or watched and read in the provided link / scenario.
In this specific case, I have observed a circumstance relating to Harry Hunter who is a 77-year-old gentleman getting palliative care. During an interval visit, he requests an additional dose of self-prescribed morphine beyond his prescribed medication. He expresses that he is in significant pain and would like an extra dose for relief. This situation raises substantial ethical and legal considerations linking medication administration, confirming the client's well-being and pain management.
  2. List relevant pieces of legislation and/or organisational guidelines that you would need knowledge of and may need to access, in order to respond to this situation. Provide a minimum of two (2) pieces of each
Appropriate legislation comprises the Aged Care Act, which highlights the rights of aged care clients to get suitable and safe care. Guidelines relating to medication administration and pain management within the context of palliative care are so important. Such regulations emphasize the significance of informed consent, the role of healthcare professionals and proper dosing in ensuring patient safety.
  3. In your role of a support worker and following organisation policy and procedure, how would you respond in this situation?
Being a support worker addressing requests by Harry needs a dedicated balance between empathy and compliance with legal and ethical standards. My response would be directed by the policies of the organisation and the dedication to giving quality care.
I would first engage in a compassionate conversation with Harry, realising his pain and discomfort. I would elucidate my role to seek his safety and well-being (Wiggins and Wilbanks, 2019). This involves following prescribed medication protocols. I would motivate him in contacting his general practitioner or palliative care team to evaluate his pain levels and top potential changes to his pain relief regime.
  4. Provide two (2) strategies that you could discuss with your manager that could be used to increase staff knowledge and awareness of how to respond if this scenario occurs again to ensure best practices are followed?
For solving similar situations and enhancing staff knowledge, I would suggest the following strategies. One strategy is to organise training sessions emphasizing meditation administration and pain management regularly in the context of palliative care. The sessions will prepare support workers with the required skills to appropriately respond pain related concerns of clients. The other strategy is to promote mediums for clear communication between the professional, clients and careers. This will lead to improving collaboration in pain management and medication changes. By promoting consistent communication, support workers can confirm clients receiving the appropriate care.
  5. Following organisation guidelines for documentation, write a file note/report about this situation. In compliance with organisational guidelines, I will document this situation in a comprehensive file note. The note will contain details about the request by Harry, a conversation and my special on the significance of contracting his general practitioner for assessing the pain (Gostin et al., 2020). With the documentation of the incident, I would confirm a clear record of my response and commitment to the well-being of Harry.
Conclusively, the scenario that Harry Hunter underlines the complex nature of palliative care and the significance of balancing empathy with compliance with ethical and legal standards. Responding suitably needs a commitment to patient safety and well-being while navigating pain management within developed guidelines.
