Assessment Two Research Essay

Relationship to other tasks and assessments:

This assessment allows you to engage in depth with a chosen research question (see Details section below). It builds upon the research and writing you undertook in Assessment One – Secondary Source Analysis. You will have already

begun research into one of the available research questions , and you must now write a complete essay response to this question based upon further research into both secondary and primary legal sources. The research essay will facilitate your development of legal research skills, ability to engage in legal and scholarly analysis, and capacity to write clear and persuasive legal arguments in an essay format.

Purpose of this assignment and ULOs assessed

The purpose of this assignment is to:

1. Assessstudents’ understanding of, and critical analysis skills in relation to, a chosen legal research question.
2. Assessstudents’ legal research skills.
3. Assessstudents referencing skills in the use of the Australian Guide to Legal Citation 4th
4. Providestudents with an opportunity to develop their legal research and writing skills.
5. Providestudents with an opportunity to explore a particular legal issue.

The unit learning outcomes assessed are:

1. Engagein academic and legal research and contextualise legal research in inquiry into particular legal issues;
2. Locateand critically evaluate the value of textual sources, synthesise information within them, and correctly cite research sources;
3. Locateand critically evaluate the impact of legal authorities – case law, legislation, international law and regulatory instruments in a wide range of contemporary contexts;
4. Understand,explain and apply legal knowledge in the analysis of primary legal sources, evaluate their relationship to each other, and determine legal currency in practical scenarios;
5. Articulateopinions in an academic manner supported by research evidence and confirm development in academic and legal literacy skills; and
6. Framethe discourse of law as one of many approaches to social problems and contextualise legal knowledge in relation to other academic, social and community discourses.

Research Essay Question

Instructions

Your essay must focus upon, and directly respond to, the essay question. For this assessment, due to the unit’s focus upon legal research, the weighting of the research and referencing criteria is higher than may normally be the case.Your essay must use clear and intelligible written expression, advance a recognisable central argument or set of arguments, conform broadly to standard essay format, demonstrate independent research on your selected topic, and provide referencing and a bibliography in compliance with the Australian Guide to Legal Citation.

Please use double spacing and Times Roman font for the presentation of your work.

Task description

1. Read over the research questions provided above. If you decide to switch from your chosen research question from Assessment One, make your final decision by the start of week two at the latest. Begin preliminary research – or continue your research – and begin essay planning.
2. In this assignment, you will rely primarily on your own initiative to complete the essay. However, there are many

resources at your disposal, including the Library, student services, your BLB1114 teacher, and your fellow students via discussion boards on VU Collaborate. Remember that we will have a workshop on secondary research in a week 1 workshop and one on essay writing in a Week 2 workshop.

3. Ensureyou have submitted your research paper to the correct dropbox by 11.59pm on the Wednesday of Week 3.

Process

Please note and follow the process steps below:

1. Readthrough and consider the available research essay questions.
2. Chooseone of these research questions by the start of week two at the latest (if switching from your Assessment One question)
3. Conductpreliminary research on your chosen topic and plan your arguments and essay structure.
4. Rememberto answer your research question – what does it ask? Does your response directly address the issue(s) raised in the question?
5. Rememberthat essays typically require an introduction stating your argument and how your essay will develop it, an essay body comprised of coherent paragraphs that logically progress your main points, and a conclusion that summarises your essay’s main points and their link to the research question.
6. Begin writing your essay, remembering to reference the factual and legal claims you make, and the work or words ofothersthat you use of refer to.
7. Rememberto double check whether your argument directly responds to the research question, whether you have a clear and effective introduction, essay body and conclusion, and whether you have referenced your factual, legal and paraphrased or quoted information.
8. Completeand submit your research paper to the correct dropbox by 11.59pm on the Wednesday of Week 3.

When you receive feedback on your research paper, you will receive a raw mark out of 100 in the dropbox as well as a

mark out of 50 in the gradebook that reflects the 50% weighting of this assignment in the unit overall. You will also receive detailed feedback in the form of a completed assessment rubric and general comments that provide an overview of how

effectively you have responded to the assessment criteria.
