You must use footnotes and include a bibliography to list all sources.

You must note the source of any diagrams or images used in the assignment.

Students are to attend (either in person live or virtually) the Courts below and observe at least two matters before a Court from the courts listed below. The matters must be civil matters. The matters must not be criminal or quasi criminal proceedings.

Each student must attend ( on line or in person), observe, reflect and report on one of each of these two categories of court events:

Category A Court event

A trial (part or whole) in any of the above courts

A hearing beforeSupreme Court(part or whole)

A hearing before Court of Appeal (Supreme Court)(part or whole)

A hearing beforeFederal Court(part or whole)

A hearing before Full Court (Federal Court)(part or whole)

An application before a Judge or Registrar

Each student must write a report about their attendance, observation, and reflection of events for each of the two court events.Each student must ensure that their report is their own work.

The report on each court event should cover the following six components:

1. The date, court room number (e.g. Court 9); full name of court, venue ( i.e. place),full name of case including parties title (e.g. Plaintiff) ; presiding Judge/s/Registrar, names of the parties and the names and roles e.g. counsel, solicitor) of lawyer/s representing the parties. You will need to watch and listen carefully. You may need to check the list held by the court officer if you miss a name. Also note if the proceedings are being conducted virtually and what practice notes, procedures etc. apply due to Covid 19, if applicable

2. Describe the type of proceeding observed. Be as specific as possible. Identify the nature of the application and the facts/ subject matter of the case. Refer to the relevant court rules (name of rules and the rule number) , any practice directions, announcements and Covid protocols which apply to the proceeding observed.

3. Describe your observations the court room environment, layout and atmosphere. Did you have any expectations about the court room? Did what you observed meet your expectations? Give specific examples

4. Describe your impression of the presiding Judge/Registrar/judicial officer note their appearance (e.g. robed, wigged etc.), their demeanour and the way the judge/registrar presided over the court. Give specific examples.

5. Describe any observations made about other persons present in the court room, including the parties in the matter, barristers/counsel, solicitors, court officer, security personnel, judges associate and/or tipstaff

6. Reflect on the operation of the court. Consider whether the aims and principles of the relevant legislation (e.g.Civil Procedure Act, court rules) were met. Consider how case management was implemented. Consider whether access to justice was achieved. Consider any alternative dispute resolution.
