ASSIGNMENT BRIEF AND GUIDANCE

Purpose of this assessment

The assignment is designed to test students understanding of the criminal justice system (CJS) in England and Wales and the importance of criminal justice policy. Students will apply their understanding of the institutions and practices within the CJS by analysing how rape and serious sexual assault is dealt with.

Scenario

The highest-ever number of rapes was recorded by police in the year ending May 2022: 70, 330. In that same time period, charges were brought in just 2,223 rape cases. Only 1 in 100 rapes recorded by police in 2021 resulted in a charge that same year let alone a conviction. Despite an increase in reporting rape in recent years, charging and conviction rates remain among the lowest since records began.

Working for the Crown Prosecution Service (CPS), you have been asked to join the CPS-Police joint strategy called blueprint for prosecuting rape and serious sexual assault. As a research assistant, your role is to provide a critical analysis that addresses the chasm between the number of reports of sexual offences in England and Wales and the number of convictions.

Task 1

Write a report that critically analyses the issues of rape and serious sexual assault in England and Wales. Themes for discussion in this report should include:

  • Evaluate different types and principles of law that can be applied to rape and serious sexual assault in the jurisdiction of England & Wales (400 words max);
  • Analyse how rape and serious sexual assaults are dealt with by English courts including the defendants right to appeal (500 words max);
  • Explore the role of various stakeholders involved in the criminal justice process involving cases of rape and serious sexual assault (600 words max);
  • Evaluate how effective the criminal justice system is in dealing with rape and serious sexual assault cases by assessing crime rates, prosecution rates, conviction rates, reoffending rates and rehabilitation programmes (600 words max).

This provides evidence for ALL learning outcomes.

This report should be submitted by 17 April 2024.

  • It should be written using 1.5 line spacing and font size 12.
  • You are required to introduce your report as well as provide a conclusion.
  • All work must be supported with research and referenced using the Harvard referencing system.
  • Use appropriate case studies, organisational examples and academic theory to support your findings.
  • You should submit your assignment to the relevant Report submission point on Moodle.

Formative Task
