Our Client: Zahra Ali
We act on behalf of the above-mentioned client, a partner at ABC Accounting Ltd, in relation to her claim against you for breach of contract and failure to pay the outstanding amount due of 8000.
This letter is being sent to you in accordance with the Practice Direction on Pre-action conduct and protocols (the Pre-action PD) contained in the Civil Procedure Rules (CPR). Ignoring this letter may lead our client to commence proceedings against you and may increase your liability for costs.
Background
On the 10th of January 2025, you entered into a legally binding contract with Ms Ali to purchase her speedboat for the amount of 10,000. At the annual new years event for ABC Accounting Ltd, you paid an initial payment of 2000 and agreed to pay the remaining amount of 8000. It was agreed that you would pay the remaining amount in 8 equal monthly instalments of 1000.
A further agreement was made, where if you default on any instalment, then the full outstanding amount would be payable and due immediately. Despite the fact that this was all written on the back of a cigarette packet, the contract is still enforceable under English contract law.
As per the agreement, you have failed to make any further payments and Our client, Ms Zahra Ali, has been unable to get in contact with you via email or phone.
