You went to Konan’s Clothes for Kids on Saturday evening at around 5:30pm to buy your two sons white shirts for a wedding they’d be part of the following Wednesday afternoon. When you arrived at the store, you were greeted by a salesclerk named Jack who helped you find two shirts.When your sons tried on the shirts, they didn’t fit. The arms were too long and the body too baggy. Jack said he could have the shirts tailored to fit. The store was closing at 6:00pm, but he offered to stay late so he could mark the clothes so they could be altered.You said you needed them by Monday at the absolute latest. Jack said it would be possible. You asked what would happen if the shirts didn’t fit when you picked them up on Monday. Jack said the tailor could make any last-minute adjustments on the spot.You paid $75 with a check for the two shirts. On Monday afternoon you got a message at work that the two shirts were ready. After work you went directly home, picked up your sons, and went to Konan’s for the shirts, arriving at about 5:30. When your sons tried them on, they didn’t fit well at all. The sleeves were still too long and the body too baggy.Jack was not there. The young salesclerk said the shirts would be okay for the wedding because the kids would have suit coats on over them. “No one will notice,” she said. But you didn’t agree. You explained that Jack promised that any last-minute alterations could be made on the spot. As it turned out, Jack and the tailor had already left for the day at 5:00pm. Nothing could be done until Tuesday. You told the clerk you wanted your money back and refused to take the shirts. You explained that you couldn’t wait until the next day because you were working late and weren’t sure the shirts could be made to fit. The young clerk said you’d have to take the matter up with Jack or Mr. Konan.
