The word limit for this assessment is: 4000 words (i.e. 2000 words per question)

The word limitation includes footnotes and endnotes, but excludes the title, bibliography and any appendix or appendices. Penalties will be imposed for work that exceeds the prescribed word limitation. The penalties for exceeding the word limitation are:

  • If a student exceeds the word limit by one word, or any number of words equivalent to an excess of up to 10% more than the limit, 5 marks will be deducted;
  • For each subsequent 10% or part thereof, 5 further marks will be deducted.

These penalties will be imposed strictly.

A missed deadline without agreed extension WILL be penalised. In line with University and School of Law Regulations, the penalty for late submission is a reduction of 5 marks for each calendar day late, up to a maximum of 5 calendar days late, after which a mark of 0 will be awarded. Part A: Case scenario

Patrialand is a developing country and an original Member of the World Trade Organisation (WTO). Patrialand has recently taken several trade measures to protect its domestic school exercise books industry.

Until 2019, Patrialand was a major producer and exporter of school exercise books. However, since 2020, the sale of school exercise books has dropped significantly in Patrialand and in the export markets. Schools and parents worldwide increasingly seem to prefer writing tablets. Moreover, low-priced school exercise books manufactured in developed countries such as Wolfland constitute tough competition for school exercise books produced in Patrialand. If domestic sales and exports of school exercise books produced in Patrialand do not pick up quickly, many school exercise book manufacturers in Patrialand will either disappear or lay off many workers. To prevent this from happening, the Government of Patrialand increased the customs duties on all school exercise books to 35 per cent ad valorem. The customs duties applied before ranged between 5 per cent (for writing tablets) and 15 per cent (for school exercise books). During the Uruguay Round negotiations, Patrialand agreed to limit customs duties on all school exercise books to 20 per cent ad valorem. Patrialand does not apply the increase in customs duties to imports from the Republic of Hipsterland, a developing country with which Patrialand has close political and economic ties.

Moreover, Patrialand recently enacted a new law allegedly intended to protect world forests and the planet. The legislation stipulates that all imported school exercise books must be made of recycled materials. In recent years, Wolfland has been a significant exporter of school exercise books to Patrialand. These exports are now being affected by this new legislation in Patrialand.

Furthermore, Wolfland recently waged war against Hipsterland. This military aggression led to an avalanche of trade sanctions by WTO Members, including Patrialand. Wolfland now threatens to leave the WTO, accusing it of being converted into a political organisation away from its original and only trade mandate. The population of Patrialand in a recent pool demands even more decisive political action, such as the initiation of procedures at the WTO to expel Wolfland.

You are a Legal Officer at the Patrialand Ministry of Trade and have been requested to write a memo briefly assessing the WTO compatibility of all the issues raised.
