Assessment Task 2: Contract administration in context (contractor or principal roles)
Introduction
Administering a contract occurs at multiple levels. Considering the administrative issues from different perspectives can assist understanding of the process.
In this task you are required to consider some contract administration scenarios from the perspectives of:
Site manager (person responsible for managing a construction site eg site level programming, ordering materials, supervising sub-contractors, monitoring progress, quality and reviewing requests for payment, project reports, etc.)
Project manager (contractor side often person responsible for managing complex/multiple sites, more strategic role in contracting organisation, often with important role managing client relationship, etc.).
Client side project manager/superintendent (not party to the contract but often engaged by principal to administer contract on their behalf. Required to be impartial and consider the issues of both the contractor and the principal in discharging their duties).
Use a risk assessment model to assist working through the following scenarios and consider in your answer:
Context
Communication and consultation
Identifying, analysing and evaluating risk
Controls and contingency planning (e.g. to keep a project on track/risk controlled) and possible consequences
Use of performance indicators
Monitoring resolve where required and review
The scenarios provided are generic only and you may apply them to any type of project, real or made up. The purpose of the assessment is for you to demonstrate your understanding of different levels of contract administration and how to apply a systematic approach to minimising risk. An example is provided below.

1. Site Manager
Context - The client requires the project completed by a set date. The contract has been tendered and won on the basis of meeting a completion date. There are heavy financial penalties for late completion. The contractor has taken on all risk with the weather. Site manager required to report twice weekly to project manager on program. The site is already heavily resourced with labour, plant and materials.
Communication and consultation - Communication and consultation required with project manager and other senior management within contracting organisation. Depending on issue, communication/consultation with design team and superintendent. Site manager to communicate within agreed lines of communication.
Identifying, analysing and evaluating risk - Impending storm cell and prolonged poor weather predicted.
Areas of impact: Timing of forecast weather event set to cause delayed completion of excavations/foundations/retaining structures.
Potential consequences include damage to partial excavations, newly poured concrete; unstable ground, increased WHS risks, impact on critical path etc. Risk to contract completion is high. Risk of financial penalties is high. Risk of damage to partially completed works and rework is high.
Controls and contingency planning (e.g. to keep a project on track/risk controlled) and possible consequences -Consult with senior management. Consider changes to methodologies, e.g. complete smaller section rather than try and complete larger section with risk of damage etc. and revisit project programming and impact on follow on trades.
Use of performance indicators - The main performance indicator is the program. The master program shows the overall contractual requirement, site level programming providing greater detail. This will be used to understand the impact of the risks and also to try and devise controls/contingencies.
Monitoring and review once a contingency plan has been devised, regular checks need to be made to ensure project is still on track. More frequent reporting may be required. Potential opportunities for future acceleration of program may be required.

You are required to develop a generic contracts administration framework that can be adapted to a range of projects. This should include.
Introduction. An over view of what is in the framework and its purpose.
Establish a contracts administration team describing the roles and responsibilities of each person.
Document control and handling including security. Including types of documentation that is required. Including record keeping, storage and security.
Internal and external communication models
Risk management.
How the framework would tie into the financial management and business administration systems of the business.
Industrial relations management
For employees
Managing sub-contractors. Make reference to Building Industry Fairness (Security of payment) Act 2017 how this impacts your management system.

Task 1.2
Using the generic framework you have developed you are to adapt and apply it to the following two (2) projects. There will be some duplication, but given the different contractual arrangements there will also be differences.
Project 1
This is a design and construct project. The brief for the project is outlined as a multi residential high rise complex with the ground floor consisting of shops and a caf which will be leased to independent businesses. To align with the neighbourhood plan the maximum height of the building is 8 storeys. The project has a time frame of 24 months which includes the design phase.
Project 2
This project is a sports stadium for a regional municipal authority. It will have a capacity of 10,000 people with seating for 1000. This seating consists of stands on one side of the oval that are to be constructed from formed and precast concrete. Using portal frames construction for the roof over the seating. It will contain all the required amenities and change rooms on the ground level. With the upper level mostly consisting of enclosed private boxes and board casting booths. All other sides of the oval will have grassed mounds with shade sails. The time frame for construction is twelve months with a completion date two months prior to a planned grand final game.
Each of the two projects will have their own unique risks contractually as well as physically. Take this into consideration while applying the management framework.
