Research Proposal
The Rwanda Policy; Is it Legal? Evaluating the Rwanda Policy from the international laws point of view.
Aims
The purpose of this research is to determine why people cross the channels on a small boat to the UK.
To analyse the immigration laws in England and Wales compared to international laws on human rights.
Objectives
Identify factors that lead to migration through the channel on a small boat.
Investigate the immigration laws that protect migrants in the United Kingdom.
Investigate the recent immigration laws put in place to deter people from the dangerous channels crossing.
Analyse how the Rwanda policy conflicts with the international laws on human rights.
Research Question
To what extent are the recent immigration laws relating to the Rwanda Policy effective?
What was the policy about?
Which category of immigrants would be taken to Rwanda?
To what will the policy deter people from channel crossing and illegal immigration in general?
What are the uncertainties?
What other countries have pursued similar policies.
Research Methodology
This research project will use a legal methodology to analyse both primary and secondary sources. The primary sources will include case law, statutes and law report while the secondary sources will be looking at journal articles and legal textbooks. The socio-legal methodology moves away from solely looking at the laws and statutes and instead explores the law in legal institutions and society from the perspective of the social sciences. Socio-legal scholars argue that it is important to go beyond traditional black-letter approach when studying the law as the law does not operate vacuum.
This dissertation adopts a socio-legal methodology to analyse primary and secondary sources. The primary sources to be used include statutes, case law and law reports. The secondary sources cover legal textbooks, journal articles and reports. A socio-legal methodology moves away from solely looking at the laws and statutes and instead explores the law in legal institutions and society from the perspective of the social sciences. Socio-legal scholars argue that it is important to go beyond traditional black-letter approach when studying the law as the law does not operate in vacuum.
A socio-legal methodology approach would be the most effective way of carrying out this research as I want to study the current law in action and not focus on the history of the law. Furthermore, I would like to explore the different perspectives on legal issues and incorporate non-legal issues into the context of law which can also be achieved through socio-legal methodology.
