Assessment 1 JUST 2005 Case study Chris youth justice
Assessment 1 JUST 2005 Case study Chris youth justice
The assessment is a written case study with an introduction and conclusion paragraph
Chris is a 15-year-old who has been arrested by the South Australian police and charged with breaking and entering a property. This young person was caught in a neighbours house searching through the cupboards and with the neighbours lap-top, video equipment and mobile phone already in a shoulder bag which Chris had brought into the premises.
The police were called when the neighbour returned home unexpectedly and found a back window had been broken and Chris was in their house. Chris was taken into police custody and the police called the parents to attend an interview at the police station and Chris was then released on bail and returned to reside in the family home.
Chris parents are very distressed about this and anxious in attending family conferencing through the SA Youth Court. Chris has not broken the law before or been in trouble with the police. During the police interview the parents also reported Chris had not been attending school, refuses to go and is not abiding by the rules at home.

Assessment 1 Guidelines
Writing the Legal Case Study
Due date: 29th September 2023
Choice of 4 Case Studies
The case study you choose to write your first assignment can be chosen from one of the following 3 options: (In option 2 there are 2 case studies).
Option 1: Chris, a 15-year-old, who was charged by the police and will be attending family conferencing through the SA Youth Court. This case study description/facts can be found under the assessment tab and titled:
Chris case study
Option 2: You can choose one of the case study scenarios from the Stop the Violence Court Video
Either The Brown Family case study or the Carole Stone case study.
You can find this video under Week 5 Domestic Violence Tab called Stop the Violence Court Video - Mock Case Studies in the Family Violence Court.
NOTE: If you are writing on one of the case studies from the Family Violence Court Video you only need to reference this source once in your introduction; not continuously throughout the assignment. It is also okay to use the names of Tracey & Geoff Brown or Carole Stone as this training video employed actors to play the parts; hence there is no issue of confidentiality
Option 3: There will be an opportunity for small groups to attend hearings at the Adelaide Magistrate open Courts and the diversion courts and or you can attend on your own a Magistrate Court near you and write about a case you observed though being mindful of confidentiality and respecting the Court process
Final Note: You can also follow up further on specific information about your chosen case including relevant legislation involved from the Legal Service Commission SAs online Law Handbook - a very useful resource to find information about your case, the offence(s) involved, court procedures and legislation and legal information.

GUIDE FOR EACH OF THE FIVE DIFFERENT SECTIONS
Introduction
Only a very brief introduction is required of approximately 3-5 sentences. For example, This case study is about a domestic violence matter which is being heard in the Family Violence Court. You could then provide a couple of sentences about the general background of the Court and its purpose, followed with a succinct outline of the layout of your discussions in your paper, drawing on the key headings below.
Brief Case Synopsis (10%)
A synopsis comprises the facts of the case. (This should only be 3-4 sentences).
Identification of Relevant Legislation (10%)
Clearly outline the full name of the pieces of relevant legislation involved with a succinct discussion of how or why this legislation is involved in your chosen case study scenario.
Courts Rulings/Interventions (10%)
In James case study you will discuss the role of the Youth Court and youth justice court legal services/interventions. In the Family Violence Court, you need to succinctly summarize the Court rulings and what the Magistrate says to the defendant in the Tracey and Geoff case. For Mrs Stone case discuss the purpose and the referral to the Family Violence Court and Intervention Orders and that Mr Stone would be served the documents to attend a Court hearing.
Human service/social worker knowledge, roles and skills required to work with the specifics of your chosen case study scenario (30%)
Knowledge you may want to discuss if drawing on either of the two case studies from the Family Violence Court Video would that of working in domestic violence: drawing on relevant and current research work in this area including best practices guidelines when working with complex situations of domestic violence within and outside of the courts legal setting. Also, important to briefly discuss 1-2 social work theory to practice models suited to working with the specifics of your chosen case study: for example, that of an anti-oppressive approach, a feminist perspective. For James case study you may want to discuss young people and their development capacity and needs, family work/problem-solution focussed, crisis intervention, working within a court system for young people, and key to understanding the young offenders legislation and family conferencing. Working across different systems and multiple levels of complexity and the challenges.
Some human service worker/social work roles you might want to research and include in this section could include that of counsellor, broker, advocate, and educator. Work here needs to clearly demonstrate your understanding of these different roles in the context of key information from the case study scenario you have chosen. Please write as specifically as you can, giving concrete examples of how these roles could be utilized when working with the specifics of the case study scenario you have chosen for this assignment.
Some human service worker/social work skills to research and discuss, again in keeping with the specifics of your chosen case study scenario, could include respectful engagement and assessment skills, skills in working in partnership with clients, cultural competency skills, and a range of other practice skills.
Social Justice and Ethical Issues (30%)
A good starting point for this section would be reviewing the AASW Code of Ethics and other universal human rights-based documents, exploring social justice and/or ethical issues relevant to the specifics of your chosen case study situation. Some social justice considerations may include in the domestic violence cases - abuse of a persons human rights. The very topic of domestic violence, for example, is a social justice issue as domestic violence itself opposes so many human rights. There may be a range of other social justice issues of ensuring protection, assisting people to know their rights, reducing any barriers involved in accessing necessary support services especially regarding individuals who are disadvantaged and/or with special needs. There may be social justice issues in regard to access to culturally appropriate interventions and services.
There may be a range of ethical issues that you find confronting; for example, confidentiality within the Court systems, or of trying to reconcile the black and white features of the legal system with the more person-centred social work approach which also focuses on client self-determination and decision making. The need for advocating for clients within the legal system and accessing services is clearly a part of the work involved here in all 3 case studies.
Conclusion
In a few sentences clearly and succinctly summarise the key points and issues discussed in your case study paper. Do not bring in any new information that has not been discussed or covered in the body of your paper.
