Overview

The graduate Video Brief is the first of three assessment items in the unit. You must undertake all three items in order to pass this course. Please refer to the Unit Outline and the Orientation week video. Note that the Video Brief is not shared with the rest of the world it is a submission for the unit convenor and the unit moderator.

The first assessment item reflects the graduate attributes identified below. It draws on what you have been taught in class up to the time of submission and what you can discern through your research (i.e. autonomous reading and analysis). It reflects an emphasis on practical skills such as communication to different audiences by people with information technology expertise, given that effective professional practice involves a range of stakeholders rather than merely legal or technology specialists. The assessment item demonstrates your ability to gain insights and communicate persuasively. Persuasion includes pertinence and clarity.

Outcomes

Unit learning outcomes alignment Graduate learning outcomes alignment

ULO1: Explain and apply the principal doctrines and remedies of equity and the law of trusts.

ULO4: Demonstrate effective legal communication, research and negotiation skills and apply them to equity and trust law problems. GA 1: UC graduates are professional

Instructions

The assessment item involves you making a three-minute video presentation that offers a cogent overview of Equity in contemporary Australia.

That overview should identify how equity fits into Australian civil and criminal law involving a range of public/private entities (for example involving government agencies, businesses, other organisations, consumers and civil society advocates), a federal system and disagreements about justice.

You are being challenged to research, think and communicate in ways that are professionally relevant but which may be unfamiliar, rather than to provide the standard essay-style answer that many students have encountered in past university units or other certification.

A useful structure for your video is

A concise introduction that identifies you

What do we mean by law?

Where does fairness fit in?

What are we trying to do with equity law?

Is it working effectively, does it need to be updated or replaced or supplemented?

The emphasis is on cogent analysis (aka critique) rather than description or high production values (e.g. perfect lighting, impressive dcor and awesome clothing). The emphasis is also on concision, so make every word count and stay within the 3-minute limit.

You need to be visible and audible on the video. Do not use PowerPoint or background graphics. The Video Brief consists of you speaking to the viewer in a way that can be readily understood.

Do not recite from a script. Do not submit a script or other supplementary item.

Recording your response

The Video Brief may be made using a mobile phone, desktop computer, stand-alone digital camera, laptop or tablet. Note the production comments above. It is your responsibility to ensure that your submitted brief does not contain malware.

Marking

Marking of this exam is on a holistic basis. The following rubric is indicative rather than determinative:

Compliance with Instructions (eg Audibility, Visibility, Length)

Pertinence of Presentation

Identification of relevant

Principles

Identification of Challenges (eg differing views of fairness)

Cogent argument

Marking will reward people who demonstrate an understanding of law and practice regarding Equity, provide a cogent accessible video and emphasise analysis rather than description.

As noted above and in class, marking will reflect the time available for preparation. It will also reflect the graduate status of the unit. Work seriously and do not panic: you will be assessed as students undertaking an intensive Priestley law unit.
