Answer all of the Following Questions:



Institutions of the EU


1. Name the three legislative Institutions of the EU, explain the membership of those bodies and the interest they represent in the law-making process (Max 100 words, 10 Marks)

2. Which Article of the Treaty describes the measures of secondary law the institutions can adopt, and what are those measures? (Max 50 Words, 5 Marks).


3. Explain the Special Legislative Procedures and evaluate the implications of using the Special Legislative Procedures on the balance of power between EU institutions. (Max 600 words, 35 Marks)


4. Explain what the democratic deficit is in the context of the European Union. To what extent have reforms to the Treaty on European Union and the Lisbon Treaty sufficiently addressed the democratic deficit? (Maximum 800 words, 50 Marks)

Demonstrated adequate knowledge of the subject area but will be limited in breadth and/or depth of knowledge and understanding. The relevant issues and principles have been correctly identified and some discussion had been provided. There will be errors or omissions in the answer. The discussion will mainly be descriptive in nature with limited use of relevant case law. Use of referencing and OSCOLA may be poor.


50-59Fair


Demonstrated fair knowledge of the subject area. Discussions surrounding the questions posed will demonstrate competent understanding of the areas assessed. Many of the main issues and principles will have been correctly identified and discussed with a reasonable level of critical discussion where required by the questions. There may still be a few errors or omissions. The discussion may still be descriptive at times but there will be a fair use of case law and perhaps academic sources, there may be gaps. Use of referencing and OSCOLA will be competent with some errors.


60-69Good


Demonstrated a good knowledge of subject area. Discussions surrounding the questions posed will demonstrate good understanding of the areas assessed. The majority of the main issues and principles will have been correctly identified and discussed with a good level of critical discussion where required by the questions, there should be few errors or omissions. The answer should identify and discuss the relevant case law and include some academic sources. Use of referencing and OSCOLA should be good with few errors.


70-79Very Good


Demonstrated a very good knowledge of the subject area. Discussions surrounding the questions posed will demonstrate a very good level of understanding of the areas assessed. All of the main issues and principles will have been correctly identified and discussed with a very good level of critical discussion where required by the questions, there should be virtually no errors or omissions. The answer should identify and discuss the relevant case law and include academic sources with a very good level of understanding and analysis. Use of referencing and OSCOLA should be very good with few errors.


80+ - Excellent


Demonstrated an excellent knowledge of the subject area. Discussions surrounding the questions posed will demonstrate an excellent understanding of the areas assessed. All of the main issues and principles will have been correctly identified and discussed with an excellent level of critical discussion where required by the questions, there should be no errors or omissions. The answer should identify and discuss the relevant case law and include academic sources with a very good level of understanding and analysis. Use of referencing and OSCOLA should be excellent with limited or no mistakes.
