Please answer BOTH questions:

  1. ‘The role of the Court of Justice of the European Unionas a human rights adjudicator is actually a relatively recent one.’ – discuss critically by drawing on relevant case law and academic literature.
  1. Connaught Colcannon’ is a premium food manufacturing company based in the west of Ireland. The company produces a range of fresh, prepared mashed potato products which are made using award-winning potatoes grown in County Mayo, together with butter, milk and cabbage/kale from the finest producers in the region. The products are labelled with the tag “Connaught’s finest, brought to you fresh and easy”. Connaught Colcannon’s products have been selling well on the home market and the company has decided to expand its sales into France and beyond. The company has conducted an analysis of the French market and has discovered the following:
  • France has introduced a ban on products made with butter, milk or cream sourced from outside the country. The authorities state that this is in the interests of ensuring the use of local dairy products.
  • French law requires that all fresh produce sold in France should indicate clearly on their labelling and packaging, the carbon dioxide impact of their production and transportation.
  • A local French company, ‘Pommes de Terre Gourmandes’ (PTG), has started selling high-end mashed potato products from its farm in Normandy. ‘Aliments Nationaux’, a large supermarket chain in France, also stocks products from PTG but has refused to deal with foreign producers of mashed potato products.
  • French law also requires producers of ‘premium’ food products to have a retail outlet located within France.
  • The French authorities have recently introduced a ban on the advertisement of carbohydrate-rich foods (such as those made from mashed potato), in print media and on television. The authorities point to concerns over rising levels of obesity as the reason for the ban.

Connaught Colcannon fears that these rules will inhibit its ability to expand into the French market. They have sought your advice as to the compatibility of the measures with European Union law.
