Nevertheless, on the 18th of June there was an announcement that the procession would be cancelled, as the weather forecasts predicted that the weather on the 20th of June would be rainy. Peter had ordered from Mary a pair of binoculars in order to view the procession, for which he paid £300. Mary imported these binoculars from Merovia. After the order had been placed, there was a political unrest in Merovia, as a result of which the import expenses for Mary were increased; as a result, she would make no profit from the sale of binoculars to Peter. 
a. Advise Peter whether he can claim the £200 he paid to John. b. Advise Mary on whether she can claim that her contract with Peter has been frustrated. 
2. Read the scenario below: 
Jane owns a ring that she had inherited from her aunt. She knows that Sarah is fond of jewellery and she tries to sell the ring to her. Jane tells Sarah that it is an antique as her aunt had told her. Sarah has little knowledge of antique jewellery and she agrees to pay £1,000 in order to buy it. Jane drew up a contract of sale, which does not mention that the ring is an antique. Sarah indeed buys the ring and pays £1,000 to Jane. A week after Sarah had bought the ring, one of her friends who knows more about antique jewellery tells her that it is not an antique and that he bought exactly the same ring in London for £100. a. Advise Sarah whether she has any remedies. b. What would be the difference if Sarah took no action for six months after finding out the truth about the ring? 3. With reference to case law, explain the differences between an offer and an invitation to treat, by referring to common examples of invitations to treat. 4. With reference to case law, refer to the law on the incorporation and interpretation of exemption clauses.
