Question 1 In October 2021, the Australian Federal Government had enacted the Online Safety Act 2021 (Cth).  The act had strengthened protections against online abuse in line with community expectations, and also imposed obligations on social media platforms to take down offending material if requested by the e-Safety Commissioner.Critically analyse the Online Safety Act 2021 (Cth) with reference to the topics on liberalism, rule of law, human rights and transnational corporations. You need to only analyse two of these concepts.

To answer this question and inform your analysis, you are required to do the following:

  • Read the provision of the Online Safety Act 2021 (Cth)
  • Read the following extracts from the Explanatory Memorandum for the act (when it was a bill pending in the parliament) to inform your analysis:
  • Outline and Regulatory Impact Statement, pp. 1-28.
  • Statement of Compatibility with Human Rights, pp. 51-63.
