Task

Discuss whether Adam will be liable for trespass to person against Carlotta.

For the purposes of this task:

• Discuss only the most relevant trespass to person cause of action; and
• Discuss the concept of the defendant’s state of mind as a defence to this cause of action.
• Do not discuss any other defences, and do not discuss remedies.

Part A

(That is, you must write an introduction only.) The word limit for Part A submissions is 300 words. Note, while you must not exceed the word limit, for this part you are not expected to use the full word limit. As noted below, assessment criterion 7 will assess your ability to write concisely; this involves, using the appropriate number of words to answer Part A.

Part B

Your submission for Part B must be a written answer for assessment addressing steps 5-9 of the Legal Problem Solving Guide as taught in this unit. (That is, you must write an answer, without an introduction.) The word limit for Part B submissions is 800 words.
