An analysis of a legal problem question is required to determine potential liability in the law of tort in respect of multiple claimants. You will need to adopt the correct approach to answering the legal problem question so that you can identify all the relevant issues raised and for each issue provide definitions and explanations of the legal rules.  You will also apply the legal rules to the issues to determine whether the defendant is liable to each of the potential claimants in the law of tort, clearly justifying your application. For both tasks, use examples to illustrate the points you make along with appropriate statute andor case law whenever possible. Use Harvard or Oscola referencing and provide a bibliography including internet website addresses AND a list of Statutes and Cases referred to in your work ensuring full citation, eg:

  • Explain factors relevant to establishing whether there has been a breach of duty of care, illustrating with examples from case law

  • Construct logical arguments based on established legal principles to critically assess the opinions of others in relation to the law of tort.
  • Quote a range of appropriate legal sources in order to provide supporting evidence for arguments and opinions presented in essays and cases studies relating to the law of tort.
