Sam and Eve Law Case Study

Assignment Task:

In November 2003 Sam and Eve purchased the registered freehold of Happy Cow Farm an organic farming business. Happy Cow Farm originally comprised 100 acres of the main farmhouse, the farmland and four cottages with a river running through It.
 
In 2008, Sam and Eve started renting the cottages out to holiday-makers. The business, "Nature Cottages" also used a small caravan as a reception. 

In 2012 Eve fell pregnant and together they decided they had too little time to run both the farm and the cottages. In September 2012 they sold "Nature Cottages" and the land it occupied to Bradley. Sam and Eve retained the remainder of Happy Cow Farm and continued to live In the farmhouse.

Bradley has made a real success of "Nature Cottages", but the following issues have arisen:

1. Bradley continues to park the reception caravan on part of the parking area In the farmyard which belongs to Happy Cow Farm. Sam and Eve had always parked the caravan in this spot when they ran Nature Cottages, but no permission was given to Bradley to do this. 

2. Sam and Eve have continued using an access road to Happy Cow Farm that crosses Bradley's land including when they drive their large milk truck to the pasteuriser. Bradley intends to expand Nature Cottages and wants to build new cottages that would block this access road. There is an alternative route to Happy Cow Farm but it goes over the river and the small wooden bridge would not be strong enough for the milk truck to pass. Sam and Eve are unhappy as this would make it difficult for them to continue running their business. 

3. During Sam and Eve's ownership of Nature Cottages a neighbouring farmer, Tyler, would fish In the river on the property every Saturday. The fishing spot is located on Nature Cottages land and Bradley would like to stop Tyler fishing as he wants to charge the guests to do so. Tyler claims to have fished this spot every Saturday since he was a child in the '70s.
