Overview
In legal practice and/or policy development you will often be required to deal with disputes involving a client. Courts, your peers and clients will expect you to exercise some creativity in problem-solving and to be proficient in communication, including communication with people who are stressed and/or without much understanding of the law. The most successful legal practitioners are those who are adept at pulling problems apart as the basis for an effective solution and who can both gain and convey information in dealings with a range of contacts.
The second assessment item challenges you to provide a cogent report.
The Report demonstrates your research, analytical and communication skills. It demonstrates your proficiency in the use of AGLC4 alongside your ability to identify and interpret instructions (a weakness in several responses to assessment item 1) and to manage your time.
The Report reflects the graduate attributes and learning outcomes identified below. It draws on what you have been taught in class up to the time of submission and what you can discern through your research (ie autonomous reading and analysis)

Instructions
Assessment Item Two requires you to prepare a 3,000 word report addressingoneof three research questions. The requirement is a flat 3,000 words, not plus/minus 10%. The Questions are given below.
You are being challenged to research, think and communicate in ways that are professionally relevant but which may be unfamiliar, rather than than paraphrasing something you have found in print, online or in a lecture.
YourReportconsists of straight prose. Do not number each paragraph. Do not use dot points. Do not offer a mock letterhead or salutation.
Provide citations of25pertinent cases, ie citation of 25 separate judgments rather than 25 footnotes citing the same judgment.
Provide citation of20pertinent scholarly articles and books.
Pertinent means relevant, something that is not the same as transcribing footnotes from a textbook and not pointing to pages in a textbook or online crib site.
As with the guidance regarding Assessment Item One, make every word count: do not waste words and do not add words just for the sake of it or to pad out a thin analysis.
Provide pertinent authority in the form of AGLC4 footnotes. Do not waste words paraphrasing a judgment in the body of yourReport. Do not park discussion in the footnotes; footnotes are for citation and not for squeezing in text you could not fit in the body of theReport.
Your answer must include:
formal citation of relevant judgments and statute/s
identification of relevant Equity issues
identification and evaluation of relevant Equity principles
discussion of practicalities
engagement with scholarly secondary literature (official or academic reports and discussion papers, monographs and book chapters in scholarly books, articles in scholarly journals). You must cite a minimum of20scholarly secondary sources. Note that Wikipedia, items from the mass media (eg theSydney Morning Heraldor ABC News) and online newsletters/briefs from law firms are not scholarly sources.
an introduction, discussion (articulation and critical evaluation of claims and data), conclusion and bibliography.
Your answer must address the question.
Footnotes and the Bibliography are not included in the word count (ie are outside the 3,000 word limit).

Marking
Marking for Assessment Item Two is based on the following criteria, consistent with the unit learning outcomes noted above
compliance with these instructions
demonstrated awareness and understanding of relevant legal principles and issues
concise and cogent expression at the graduate level.
Marking will reward people who demonstrate an understanding of legal issues, engage with detail (eg draft and carefully proofread), show their skill in research and emphasise analysis rather than description.
As noted above and in class, marking will reflect the time available for drafting and revision. It will also reflect the later year status of the unit. Work seriously and do not panic.
Marking of this assessment item is on a holistic basis. The following rubric is indicative rather than determinative

Referencing style: You must provide an AGLC4 bibliography (aka reference list). Note that AGLC4 bibliographies have a special format, different to footnotes.
