To remedy that, and to create a set of resources, this assessment will have you working in groups on a topic that you will choose. In groups you are to research and revise the topic, including the essential elements of the right being explored. You are then to showcase this information in a creative way. For example you may wish to do flash cards, a mind map, an information poster or a quiz. Or you may want to push the boundaries a little more- an animated cartoon, a podcast where you discuss the topic, a movie of an important case where the elements are explored. You can do anything you want (but please read the marking criteria and check with the subject convenor if you are not sure!)
The idea is that after they have been assessed (and amendments made if necessary) students will get the opportunity to share these materials with the cohort creating a resource centre for everyone to use and engage with.
Apart from getting marks for necessary revision- what is the point of this assignment?
This assignment adheres to the philosophy of open pedagogy a part of open educational practices that seeks to challenge learners to become co-creators of course content. The foundational values of this practice are:
autonomy and interdependence;freedom and responsibility;democracy and participation.
It is a way of setting goals where students can see the value, and where a community of learners can come together to support each other with new technologies and interactions. And also, because it is a lot more fun than constant quizzes testing your rote memory.
How will it work?
Students will join a group on vUWS via the group link below. As a group you will need to pick:
a module or topic such as Negligence, Contracts, Administrative Law or Equity and Trusts
either a revision of elements or a case study of a key case
a way of presenting that information- you can be as creative as you like. A poem, an information poster, a quiz, flash cards, a youtube explainer, a game......the list is endless!
If you are stuck for an idea please do not hesitate to reach out to the subject coordinator!
You will be assessed on:
Originality and creativity
Correctly and relevantly identifying and explaining the elements and issues needed to make this a resource others will find helpful
Introduction to Tort Law- Intentional Torts KORAY
Tort law is a complex and nuanced area of law. On face value it can seem simple, but it contains layers much like an onion that unravel into intricate concepts and principles. It only gets deeper once we introduce remedies and look at tort laws' interaction with remedies. Remedies in tort law are the mechanisms through which the legal system seeks to address and rectify the harm caused by a tortious act.
Most of us study Torts in our first year or two in law school however its principles continue to play a crucial role throughout our legal careers and bridges onto the subject of remedies. Remedies in tort law are designed to compensate the injured party for the harm they have suffered. This compensation can take the form of monetary damages, injunctions, or other forms of relief which we have seen or will soon see in Remedies!
What is torttort refers to a civil wrong that causes harm, leading to legal liability for the person who commits the wrongful act.
A Focus on Negligence Negligence is a wrongful act that occurs when someone breaches their duty of care, causing harm to another person or their property. Unlike intentional torts
Below are the elements to Establish a Duty of Care for Negligence

Ok, dont let that word creative scare you- let me break it down for you....
The one issue students constantly have in this subject is the demarcation between the subjects they have previously studied and the remedies to be applied in this subject. This is because to apply a remedy you need to recognise the right being interfered with and that takes assumed knowledge on your part of the elements of those rights. While in Remedies you may not need to go into as much detail as to duty of care, for example, you will need to recognise it exists and that there has been a breach, before you apply the remedial questions of causation and damage. Because of this you will need to refer back to your notes on Torts, Contracts, Equity, and Administrative Law (along with others). It may be that you studied Torts so long ago that you can barely remember what the snail in the bottle was all about!
To remedy that, and to create a set of resources, this assessment will have you working in groups on a topic that you will choose. Students own the copyright of their own work and it should be agreed between the team members whether you want to share the resource with others. You will be required to email the subject co-ordinator to opt out if you do not wish your project to be included. I will upload a resources page with all of the projects. Students will also have a chance to take on the feedback provided so that you can be sure the resources are not misleading.
