Ethical dilemmas: “two or more courses of action that are in conflict (and will potentially have both positive and negative consequences), each of which can be defended as viable and appropriate” (Weinberg, 2009, p. 144).

Task:

Upload your responses as Part B of Assessment 2 by week 9

Case scenario:

You work in a counselling service catering to homeless young people, where you have been for 6 months. One day two detectives from the homicide squad come to see you. They wanted to ask you about one of your clients, a young man with a history of violence, petty crime and drug abuse. They stated that he might somehow be involved in a recent murder. They want to ask you some questions about his state of mind, drug use and relationship with the victim. You are uncomfortable talking about your client with outsiders and tell them you would have to speak to your supervisor. The police officers became agitated, even aggressive. They suggested that your unwillingness to cooperate with their inquires would amount to obstruction, and perhaps even an attempt to pervert the course of justice. You feel like you’ve been threatened with arrest. Despite your better judgement you give them an interview and the police went away satisfied.

  1. What ethical considerations can you find in this scenario? (2 marks)
  2. Identify the competing ethical principles in this scenario (ie, clusters: autonomy/paternalism; confidentiality/duty of care; social control/toleration) and explain how they relate to this dilemma. (2 marks)<
  3. Do legal and ethical considerations overlap in this scenario? If so how/ If not why not? (2 marks)
  4. What ethical theory or perspective are the detectives coming from? (virtue, deontological, consequentialist) (1 mark)
  5. How would you have responded to the detectives? What values do you hold personally that would impact your decision on how to respond to the detectives? (3 marks)
