Everglow is a company registered in England. In September 2020, it purchased 200,000 litres of hand sanitiser from Cleanhands Ltd, a seller based in Poland. The hand sanitisers were to be delivered to London, no later than 1 November 2020.
Cleanhands shipped the hand sanitiser on board the Adventurer, a vessel registered in Latvia on 1 October 2020. However, The Adventurer, instead of proceeding directly to London, as agreed, was ordered to divert to Hamburg to load another consignment of cargo. As such, the hand sanitiser did not reach London until 15 November. By this time, the market for hand sanitisers had declined. Further, on inspection, Everglow discovered that the hand sanitiser was non-compliant with the UK Health and Safety Regulations and as such not suitable for use. Cleanhands argues that under Polish law, the hand sanitiser is suitable for use.
