IT Biz Solutions has a range of policies and procedures related to IP, ethics and privacy.

These are:

  • Privacy Policy and Procedures
  • Copyright Policy and Procedures
  • Staff Code of Conduct

These policies are included in the staff manual. Regular training is provided on these policies in the form of a presentation, especially for new staff.

A questionnaire has recently gone out to all staff to ask them about their adherence to the Copyright Policy and Procedures, Privacy Policy and Procedures and Staff Code of Conduct. Their responses are included in a case study to review and analyze. Use your review and analysis to complete the following assessment activities.

G. 1 Develop a presentation designed to provide support and advice to a team on IP, ethics and privacy

Your presentation must:

  • Summarise IT Biz Solutions organization's policies and procedures
  • I include example actions that ensure that IP, ethics and privacy requirements are not breached.

Include the title of your presentation here and submit a copy.

Also, note the questions you will ask your Team at the presentation to ensure their understanding of what you have presented.

G.2 Outlines three risks of not abiding by IP, ethics, privacy policy, and procedures. (80- 100 words) Provide a brief assessment of these risks regarding their likelihood and consequences.

The following are the major risks of not abiding by IP, ethics and privacy procedures:

Legal consequences and damage to reputation: if there is a failure to respect intellectual property, the client may face legal actions such as fees and fines. Copyright materials such as software must be used with licenses and permissions. Further, ethical violations such as mis presentation and data misuse can damage the organizational reputation. Disregarding privacy policies and procedures can lead to data breaches and damage financial capabilities and reputation. Likelihood: moderate, Impact: High

Loss of competitive advantages and innovation: failure to protect IP can lead to the theft of data and ideas, and therefore, competitive advantages are lost. Ethical concerns arise with stifling innovations and impact product development. Likelihood: moderate, Impact: moderate Impact on business and trust erosion: The Client may lose customers' trust and may have to pay regulatory penalties while affecting employee morale. G.3 Are your Team abiding by the IP, ethics, privacy and procedures? As part of answering this question, describe any internal and/or external non-compliance and intellectual property infringement incidents that have occurred. (80- 100 words)

The Team abided by ethics, IP and privacy policies and procedures and no such internal and external non-compliance case was observed. However, in some cases, the policies and procedures are not strictly followed, but it has not resulted in any infringement due to right-time supervision and monitoring.

G.4 Based on your review, do you consider the IP, ethics and privacy policies and procedures sufficient to prevent infringement? (80- 100 words)

In all cases, privacy policies and procedures are insufficient because the organization has partnerships with some other organizations and may share the information to gain business advantages. Further, anonymity is managed with the user's consent, but there is no default protection for the individual's privacy. The marketing and other campaigns may use intellectual data, which can lead to ethical issues. There is also a need to improve the IP and ethics procedures so that individuals can manage the data more confidentially and ensure client satisfaction.

G.5 What opportunities are there for improvement to the policies and procedures? (50 - 100 words)

The organization can delete the information once the intended purpose is fulfilled. The information can be retained in certain cases, but it must hide the personally identifiable information. The policies and procedures regarding access rights on archived and ongoing data can be improved. Sharing and transmission of data outside the organizational boundaries are required to prohibit. Therefore, there is an opportunity to improve the policies and procedures by closing the gaps.

G.6 Research potential IP, ethics and privacy policy and procedures from the Internet and give examples of changes that can be made. Make sure you reference the research you have conducted when providing examples. Further, make sure you outline at least two opportunities for improvement. (50 - 100 words)

The policy and procedure can clearly define the terms and guide the resources to set the preferences. It should provide instructions to secure personal and client information and lead to how to manage interactions with third parties. For example, the organization shares information with third parties, but it can clarify how and what kind of information can be shared and used across the business functions.
