Jemima has had a hobby farm in her backyard for over 20 years. She has bees for honey, chickens for eggs and three large fruit trees. She houses the bees in a hive like structure she made herself. Building regulations provide that all beehives must comply with the Biosecurity and safety of Bee's Act NSW 2015 which protects the health of bees and safety of person and property in the vicinity. Jemima's beehive did not comply with the fixed form beehive structure required. Instead, Jemima had used material which was both too cheap and unsustainable. She had built her hive this way based on Rita's do it yourself hobby farming blog which stated that ‘...a beehive supports itself and the human built hive structure is only helpful to prevent hive destruction in one case in every 10 000.’ . Recently the roots of the fruit trees have appeared in the yard of Robert, Jemima’s neighbour. Robert is concerned they will damage his swimming pool. Robert is also annoyed by the smells and clucking of Jemima’s hens. Over the last 12 months he has repeatedly expressed his concerns to Jemima but she does nothing except give him free honey. The most recent incident involved Robert yelling over the fence at Jemima ‘If you don’t do something about those stupid hens I will, and it won’t be pretty’.= On the 8th September 2021, a hot day, Robert is sun-bathing by his pool. He is sipping his third glass of champagne. Suddenly a large gust of wind destroys the bee hive in Jemima’s property. The bees escape. Frightened, and blown by the wind onto his property, they attack Robert.
