Task 1 is designed to enable you to demonstrate that you understand diminished responsibility in Scots criminal law and that you can communicate that understanding in writing. The most effective way to do that is to explain the law in your own words.
Read the question carefully. What is the subject of your speech at the conference? Don't overthink things. We are not trying to catch you out. Read both the scenarios for Ian and Bob.
For part a) you need to identify what charge Ian is likely to face and the actus reus and mens rea of that crime. You also need to identify what charge Bob is likely to face and the actus reus and mens rea of that crime.
For part b) you need to analyse what Ian has said by way of explanation for his actions with reference to the relevant law and also what Bob has said by way of explanation for his actions with reference to the relevant law. Based on your application of the law remember to include whether Ian is likely to be found guilty or not guilty and whether Bob is likely to be found guilty or not guilty.
