Students are expected to provide a brief outline of theconcepts discussed in the question, and then write an original analysis of the issues raised in the question, putting forward potential solutions (where applicable). Students should conduct additional research to help them answer the question, and to justify and support their analysis and discussion. Students may use peer-reviewed journal articles, or any credible online source
Question:
As discussed in this course, when selling a property, particularly when selling a property off the plan, there is
a substantial amount of information that a developer (or seller) must disclose to a buyer. The disclosure
documents can be complex and difficult for a buyer to understand, and some buyers may enter into the
contract without fully understanding their legal obligations. Do you think that these disclosure documents arenecessary, or would it be better to place the obligation on the buyer to find out information about the
property themselves before they buy it? Are buyers able to understand these complex disclosure documents?
Are there any ways that the disclosure documents, or the information contained in the disclosure documentscould be made less complex, and easier for buyers to understand?
