Rationale

Assessment #1 provides students with an opportunity to demonstrate engagement with the law (common law, statute, and equity) applying to land contracts in Queensland. Students will develop skills of legal analysis and written communication in the context of the legal principles and practice of land dealings in Queensland.

Task Instructions

Essay:

For submission in week 4 of the trimester, engage with the course materials and undertake some research to write an essay; that is, in the form of a possible submission to the Conveyancing and Property section of the Australian Law Journal.

The topic of the essay is , An equitable interest as an interest in section 188 of the Land Title Act 1994 (Qld): a demonstration of the interaction between the rules of law, principles of equity, requirements of statute, and between legal, equitable and statutory remedies.

Students should ensure their essay engages with LAW342 course content, including clear references to, and examination of, legislation, equity, and case law, as relevant.

Oral presentation/discussion:

Schedule and attend an individual, five-minute session to discuss your essay with the Course Coordinator. Scheduling is via the Calendly link in the Assessment #1 section of Studydesk (available at the commencement of week 3). Note that, consistent with the UniSQ Assessment Policy, limited changes are possible once a session is scheduled. Changes should be arranged, as soon as practicable, via email to the Course Coordinator, at julie.copley@unisq.edu.au. Note also that students who do not attend an oral presentation/discussion session will not achieve a passing mark for this assessment, even if a written essay has been submitted.

Submission Information

The essay is to be submitted via the Assessment #1 portal on the Assessment section of the LAW3424 Studydesk. It is to be submitted as a PDF document.

Do NOT include a coversheet or title page.

Turnitin has been enabled so that students can check for similarity matching prior to the due date. Students can make amendments to ensure appropriate referencing and compliance with acceptable Academic Integrity standards.

If internet or other difficulties prevent submission, the essay must be emailed in a PDF document to the Course Coordinator, at julie.copley@unisq.edu.au. The email must be received by the Course Coordinator as soon as practicable after the due date and time, and must be accompanied by an explanation (including screenshots, as relevant) for the failure to submit by the deadline.

Return of Assessment Items and Feedback for Learning

Feedback and marks will be returned as soon as practicable. It is anticipated that will be within 15 UniSQ business days. They will be made available via the Assessment #1 portal.

Students should consider use that can be made of the written feedback to deepen learning in LAW3424.
