Note:If you can not attend the actual exam, a deferred exam will be conducted on Saturday 4 November from 9:00am to 12:00pm AEDT. You will need to apply to the unit convenor for special consideration to take the exam at this later date.
Instructions
As highlighted in every week of the unit, the exam features two questions: one on Equity and One on Trusts. Both questions must be answered. Each question has equal marks.
You are permitted to use any material except UC Library books and purchased/gifted/ borrowed notes or answers. Your answer to each question must be your own work. You are not permitted to use a LLMs such as ChatGPT.
Answer each question by reading the relevant problem scenario and then providing advice using the IRAC method you encountered in the Foundation units.
Type your answer in a Microsoft Office (doc or docx) document. Do not submit an ODT, PDF, TXT, other formats. A corrupt or unreadable file will be taken as not having been submitted.
Save as you draft. Provide the answer to both questions in one document. Upload your answer to the Exam drop box on Canvas. The drop box is at the bottom of the main Canvas page for the Equity & Trusts PG unit. Keep a copy of your answer.
Marking will reward your problem solving, not how quickly you can type. Do not bulk up your answer with irrelevant quotations from a publication or a paraphrase of a judgment.
There are no extensions. You cannot read this document and choose to attempt the deferred exam.
Length
Please ensure that all text submitted is concisely written and relevant to the issues you have identified. The absolute maximum word length is 2,000 words (1,000 words per question), not +/- 10%. Answers that are over that length and feature irrelevant material will be penalised.
Cutting and pasting from your own notes is not prohibited, but should be used with caution as it can easily lead you to include material that is insufficiently concise or relevant.
Citation
You must cite relevant authority using AGLC4.
Do not provide a bibliography and do not refer to scholarly articles or reports. You are restricted to pertinent Australian and UK judgments and pertinent Australian statutes.
Citation must be in-text. Do not use footnotes or hyperlinks.
Technical issues
If you encounter technical issues during this exam, please take the following actions as soon as possible:
Send an email to the Unit Convenor containing:
your exam answer (Word doc), if you have attempted to submit via Canvas and the submission has failed (this email will effectively timestamp your attempt to submit)
a screenshot or other supporting documentation to prove that there has been a technical issue

General tips for Law exams
Stating and applying the law can be a simultaneous process for each issue. Nevertheless, when stating the law:
formulate rules and principles concisely
do not summarise the whole area of law: stick to the relevant rules and principles
quote key (short) passages as needed
use primary (cases, legislation) rather than secondary sources
some analysis here may be appropriate, for example, on the limits of the legal rule and exceptions to it in case law.
When applying the law:
refer only to the material facts as you go
trace your reasoning/interpretive process explaining why you applied the rule in the way you did, and rejected alternative applications, including plausible interpretations of words and phrases from the law and the facts
apply rules of precedent:
e.g. reasoning by analogy, identify similar facts in cases and align them with the facts in your case; or
distinguish your fact scenario and argue why the law should be applied differently; or
argue that previous cases only stated the rule in obiter dicta (i.e. it wasn't necessary for four judges to achieve the result) and therefore justify departing from the rule; or
argue that the original case was decided incorrectly (easier if there is a dissenting opinion that you can cite (though acknowledge that it was a dissent)).
explain the outcome or implications of the application of law.
Exam submission guidelines
The exam submission portal with the text of the exam will open at 18:30 AEST/AEDT Wednesday, Week 7, 11 October 2023 and the exam must be submitted by 21:30 AEST/AEDT Wednesday, Week 7, 11 October 2023 (total time is 3 hours). Please make sure you access this via the 'Assignments' tab of the left-side menu in this unit.
The exam is not invigilated.
In the case that a time extension is indicated in a Reasonable Adjustment Plan, please check that the submission deadline has been adjusted accordingly.
Late submissions will be penalised by one mark for every minute that passes after the submission time.
Submissions should be uploaded as a single Word file (.doc or docx), ie not a separate file for question 1 and a separate file for question 2. A corrupt or unreadable file will be taken as not having been submitted, so please check your uploaded submission carefully.
Submissions will be reviewed by the Universitys plagiarism-checking software and, with reasonable grounds, be subject to further inquiry through the Office of the Associate Dean of Education.
In the event of the onset of illness during the exam, please inform your unit convenor immediately by email. No consideration will be given for illness after the examination has been submitted.
There is no need for an assessment item coversheet. Your opening of the Exam Instructions and submission of your Exam Answers signifies that you comply with the Student Conduct framework regarding academic integrity (eg that the exam was undertaken by yourself without assistance).
Allowance will be made for students whose RAP provides for extra time in exams.
